Terms of Service

1. Acceptance of terms
By accessing or using MicroBackups ("Service"), you agree to be bound by these Terms of Service. If you are using the Service on behalf of an organisation, you represent that you have the authority to bind that organisation to these terms.
2. Description of service
MicroBackups provides automated cloud backup and recovery services for Google Workspace and Microsoft 365 environments. The Service is provided on a subscription basis as described on our pricing page.
3. Account registration
You must provide accurate and complete information when creating an account. You are responsible for maintaining the confidentiality of your account credentials and for all activities that occur under your account. You must notify us immediately of any unauthorised use.
4. Acceptable use
You agree to use the Service only for lawful purposes and in accordance with these Terms. You may not use the Service to store or transmit unlawful, harmful, or infringing content, or to interfere with the Service's operation or other users.
5. Data ownership
You retain all ownership rights to the data you back up using the Service. By using the Service, you grant MicroBackups a limited licence to process, store, and transmit your data solely for the purpose of providing the Service. We do not claim ownership of your data.
6. Data processing
MicroBackups acts as a Data Processor for personal data contained in your backups. Processing is governed by our Data Processing Agreement (DPA), available on request. For the purposes of GDPR, you are the Data Controller.
7. Subscription and billing
Subscriptions are billed monthly or annually in advance, per user. Pricing is as published on our pricing page. We reserve the right to change pricing with 30 days' notice. All fees are non-refundable except as required by applicable law.
8. Free trial
We offer a 14-day free trial with full access to the Service. No credit card is required. At the end of the trial, you must select a paid plan to continue. Trial accounts that are not converted are paused and backup data retained for 30 days before permanent deletion.
9. Service availability
We target 99.9% uptime for the backup and recovery service. Scheduled maintenance is performed during low-traffic windows with advance notice. We are not liable for downtime caused by factors outside our reasonable control.
10. Limitation of liability
To the maximum extent permitted by applicable law, MicroBackups' aggregate liability to you for any claim arising out of or in connection with the Service shall not exceed the total fees paid by you in the 12 months preceding the claim. We are not liable for indirect, incidental, or consequential damages.
11. Termination
Either party may terminate this agreement at any time. Upon termination, your access to the Service will cease. Your backup data will be retained for 30 days after termination, during which you may export it. After 30 days, data is permanently deleted.
12. Governing law
These Terms shall be governed by and construed in accordance with the laws of the jurisdiction in which MicroBackups is incorporated. Any disputes shall be subject to the exclusive jurisdiction of the courts of that jurisdiction.
13. Changes to terms
We may update these Terms from time to time. We will notify you of material changes by email or in-app notice at least 14 days before they take effect. Continued use of the Service after that date constitutes acceptance of the updated Terms.
